1. Article 32, Duration of Agreement, of the current Agreement shall be amended by replacing the date October 21, 2009 in both places where it appears with the date October 21, 2010, thereby extending the current Agreement by one year.

2. It is understood that there shall be no layoffs of bargaining unit employees for the balance of 2009. There will be no layoffs or reduction of employees due to any consolidation and/or transfer of work out of any bargaining unit in Local 363 to any bargaining unit or non bargaining unit within Frontier until October 21, 2010. In the event of a severe and unanticipated economic downturn, the parties will expeditiously meet and discuss the situation.

3. During the term of the extended Agreement, basic wage rates will remain unchanged for employees in the bargaining unit. There will also be no lump sum increases.

4. The Performance Bonus for 2009 (payable in July 2009 and January 2010) under Article 15 of the current Agreement, Section 15.09 A, shall be .5%, and for Section 15.09 B (payable in 2010) shall be $200 for 2009. For 2010, the Performance Bonus for 2010 (payable in July 2010 and January 2011) under Article 15, Section 15.09 A, shall be the same as what was available for 2008, and for Section 15.09 B, shall be the same as what was available for 2008.

5. For 2009 only, employees in classifications that are not eligible for a Performance Bonus under Article 15 shall take one personal day without pay. The Company will allow this day to be taken as an additional work hour reduction for 8 weeks or an 8 hour day.

6. Employees shall be placed on a 39 hour scheduled workweek effective the week
beginning May 10, 2009 through the week ending December 19, 2009. Pay for vacation, illness absence, and any other paid time off will be adjusted so as to effectuate a paid basic workweek that is 39 hours. A full-time employee's accrual of service and seniority shall be the same as if the employee was working a 40 hour scheduled workweek.

7. All other provisions of the current Agreement shall remain in full force and effect in accordance with their terms. Any provisions not addressed above with an expiration date of October 21, 2009 shall be amended to expire on October 21, 2010.

8. WAH date of September 30, 2009 be changed to October 21, 2010

9. All MOA's or Policies in the collective bargaining agreement that were to expire with the 2006 CBA will be extended to October 21, 2010.


10. The 19% premium (or premium equivalent) contribution percentage for medical plan coverage shall not be increased. Anthem EPO and PPO employee premiums shall remain at 2009 levels for each type of coverage level. The Company will not exercise its rights under Article 27 to increase co-pays and deductibles; co-pays and deductibles for the EPO and PPO Medical Plans will remain the same in 2010 as they are in 2009. It is recognized that HMO premiums, deductibles and co-pays are determined by the carrier.


This MOA will be effective May 12, 2009, if, and only if, the Company receives from the Union, on or before May 12, 2009, written notice that this MOU was ratified by the results of the voting in the bargaining units represented by the Union.
